Federal Court Makes Ruling in Mille Lacs Case

Last Updated: May 1, 2025By

HUGE WIN! – The Mille Lacs Band announced they would not appeal to the US Supreme Court as 8th Circuit Court of Appeals sides with County.
WE WON! Thank You for your continued support of PERM’s quest for Equal Hunting and Fishing Rights for all. Thousands of Mille Lacs County citizens, wildlife and Minnesota’s sporting community won! PRESS RELEASE: Mille Lacs County Press Release

  • The Mille Lacs Band of Ojibwe filed a lawsuit against Mille Lacs County over law enforcement disagreements but included re-establishing the 61,000 acre 1855 Treaty Reservation. This could change the lives of thousands of citizens of Isle, Wahkon, Onamia, and surrounding townships, plus affect the way natural resources are harvested.
  • Minnesota District Court Justice Susan Nelson agreed with The Band, thus changing about 160 years of history.
  • Mille Lacs County appealed Justice Nelson’s decision, PERM and MERF (Mille Lacs Equal Rights Foundation) and several townships filed Amicus Briefs supporting The County appeal.
  • The 8th Circuit Court of Appeals sided with The County by unanimously vacating Justice Nelson’s decisions and by a 2-1 majority explained why the Mille Lacs Reservation almost certainly had been disestablished by treaties, agreements and Congressional actions long ago. • Mille Lacs Band requested rehearing by the full 8th Circuit Court, but the rehearing request was denied, validating the Appeals Court Decision.
  • The only appeal left would be the US Supreme Court.
  • The Mille Lacs Band notified Mille Lacs County in a written document announcing they would not appeal to the US Supreme Court.
